The petitioner is languishing in jail since 25.06.2016 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act.
From the shop of the petitioner, 2 kgs ganja were recovered.
It is submitted by the learned counsel for the petitioner that mechanically the weight of seized ganja has been recorded in the seizure list. The petitioner has never been made accused in a case registered under NDPS Act, though, he is accused in one other case registered under Electricity Act. Mr. J.N. Considering the recovery between small and commercial quantity, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Nalanda at Biharsharif in connection with Harnaut (Chero) P.S. Case No. 177 of 2016.
