The petitioner seeks bail in Kahalgaon( Rasalpur) P. S. Case No. 266 of 2019 instituted for the offence under Sections 188/290 of the IPC and Sections 30(a) and 56(D) of Bihar Excise and Prohibition Act.

It is alleged that in course of vehicle checking police apprehended a motorcycle on which petitioner and two other persons were found sitting. It is further alleged that 12 litres of country made liquor has been recovered from bag of Gautam Anand Jha @ Gautam and 13 litres of country made liquor has been recovered from bag of Rajiv Kumar Sah.

There is no recovery of any illicit liquor from possession of this petitioner.

Patna High Court CR. MISC. No.39535 of 2019(2) dt.01-07-2019 2/2 Petitioner is in custody since 28.4.2019.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge- II cum Special Judge, Excise Act, Bhagalpur, in connection with Kahalgaon( Rasalpur) P. S. Case No. 266 of 2019 subject to the condition that both the shall be the close relative of the petitioner.
