Petitioner seeks bail in connection with Duraundha P.S. Case No. 65 of 2016 registered under Sections307/34/120B of the Indian Penal Code and section 27 of the Arms Act.

The allegation against the petitioner is that while the informant was sitting at Kali Sthan about 100 meters from his house where petitioner was also present, he called Jitesh Kumar by mobile and Jitesh came and fired upon the informant. Learned counsel for the petitioner submits that informant has raised suspicion against the petitioner as a conspirator of the occurrence without any basis due to village

Patna High Court Cr.Misc. No.49363 of 2016 (3) dt.17-01-2017 2/2 politics. It is further submitted that allegation of firing is on coaccused. Petitioner is in custody since 08.04.2016. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VIII, Siwan in connection with Duraundha P.S. Case No. 65 of 2016.
