JUSTICE SUDHIR SINGH ORAL ORDER 07-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 341, 324, 326, 386, 307, 452, 504, 120B and 506/34 of the Indian Penal Code.

Allegation against petitioners is that they fired shot upon informant's uncle with an intention to kill him. It has been submitted on behalf of petitioners that earlier prayer for bail of petitioners was rejected vide Annexure-1 to the present application. It has been pointed out that wrong submission was made by learned counsel for informant where it was alleged that the injured person subsequently had died. In fact, the injured is still alive and the case is for the offence under Section 307 and other allied Sections of the Indian Penal Code. The petitioner is in custody since 16.5.2016. Chargesheet has been submitted against petitioners. There is no allegation of tampering of witnesses against petitioners. General and omnibus allegation has been made against petitioners and others. No specific injury has been

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case no. 87 of 2016.
