The petitioner seeks bail in Kotwali P.S. Case No. 566 of 2016 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Around 6 litres of foreign liquor is said to have been recovered from the possession of the petitioner and for that the petitioner was apprehended by the police.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has been falsely implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner. He has
Patna High Court Cr.Misc. No.26610 of 2017 (2) dt.14-06-2017 2/2 got no criminal antecedent. As a matter of fact, the bag from which the liquor was seized does not hail to the petitioner rather it belongs to some other person who fled away after dumping the same and the petitioner was apprehended by the police with the said bag. The petitioner is languishing in custody since 22.10.2016.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-IV, Bhagalpur in connection with Kotwali P.S. Case No. 566 of 2016.
