JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2017 The petitioner seeks regular bail in connection with Govindpur P.S. Case No. 21 of 2017, registered for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of two hundred litres of country wine from the petitioner and other accused person. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, he has sufficiently been punished for the said offence as he has been in judicial custody since 10.03.2017 and other co-accused has already been granted bail by this Court vide order dated 14.06.2017, passed in Criminal Miscellaneous No. 26524 of 2017. Heard learned A.P.P. also.

No.26475 of 2017 (3) dt.18-07-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and also that other co-accused persons has already been granted bail by this Court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nawada, in connection with Govindpur P.S. Case No. 21 of 2017, subject to the following conditions:- It is also made clear that if the petitioner again found involved in any of such offences, in future, his bail bonds will be cancelled.
