2. The petitioner seeks bail in connection with Maheshkhunt P.S. Case No. 57 of 2026 registered for the offence punishable under Sections 96, 303(2) and 3(5 ) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner along with one Pawan Sharma is alleged to have kidnapped the victim.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the victim girl in her statement has said that she had eloped with Pawan Sharma on her own. He next submits that the petitioner being the Maternal Aunt of the victim has no role to play in the alleged offence. The

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria/ concerned Court in connection with /Maheshkhunt P.S. Case No. 57 of 2026.

7. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
