JUSTICE DINESH KUMAR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE ) Date: 16-01-2017 The petitioner has sought quashing of the contract of giving exclusive privilege to respondent no.4, alleged to have been granted without any reference to the earlier rates quoted by the candidates in the previous tenders, causing huge loss to the exchequer. The other prayer is to cancel the exclusive privilege and to refund of the excess amount.
The exclusive privilege granted to respondent no.4 stands withdrawn consequent to introduction of complete prohibition in the State by the amendments carried out in the Bihar Excise Act,
Patna High Court CWJC No.11471 of 2015 dt.16-01-2017 2/2 1915, later substituted by Bihar Prohibition and Excise Act, 2016. In view of the above, we do not find that there is any subsisting grievance which requires interference of this Court at this stage.
Accordingly, the writ application is dismissed. (Hemant Gupta, ACJ) (Dinesh Kumar Singh, J) Ashwini/- AFR/NAFR NAFR CAV DATE NA Uploading Date 20/01/2017 Transmission Date
