The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 379, 307, 504 and 385 of the Indian Penal Code.

It is alleged that co-accused Dinesh Yadav assaulted the informant with dabia, whereas co-accused Ramesh Yadav tried to strangulate the informant and also snatched Rs.2200/- from his pocket. It is alleged that petitioner no. 1 Sitaram Yadav and other persons

Patna High Court Cr.Misc. No.34817 of 2015 (2) dt.01-09-2015 snatched the motorcycle of Ambesh Kumar Singh and the informant.

It is submitted by the learned counsel for the petitioners that accusation has been levelled in the background of pending Title Suit No. 318 of 2014. Statement has been made in para-3 of the petition that except petitioner no.2 all other petitioners have no criminal antecedent. Considering the accusation levelled in the background of pending Title Suit and the accusation of assault is not against the petitioners, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Sunil Kumar Singh, Judicial Magistrate, Ist Class, Madhepura in connection with Gamharia P.S. Case No. 170 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. (Dinesh Kumar Singh, J) P.K./- U T
