2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 387/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. The case of the prosecution is that the petitioner along with others having arms arrived in the river on boat and demanded ransom and they also fired pistol in air. It has been stated that out of four miscreants, one Pawan Kumar Mahto was apprehended by the informant who disclosed name of his associates. This petitioner is amongst them.

4. Learned counsel for the petitioner has submitted that from perusal of the FIR it is clear that the fire did not hit anyone and there is only demanding of ransom. Learned counsel for the petitioner has also submitted that the said Pawan Kumar

Patna High Court CR. MISC. No.39195 of 2025(3) dt.04-09-2025 2/2 Mahto who was apprehended from the place of occurrence has been granted bail by the learned Co-ordinate Bench vide Criminal Miscellaneous Case no. 70111 of 2023. The case of this petitioner stands on better footing. The petitioner is in judicial custody since 24.03.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barari P.S. Case No. 61 of 2022 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar.
