Petitioners apprehend their arrest in connection with Paroo P.S.Case No. 57 of 2011 registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code.

Allegation against petitioner No.1 is that she has taken away the deceased along with other accused persons and thereafter dead body of son of the informant was recovered. Submission of learned counsel for the petitioners is that other co-accused persons have been granted privilege of anticipatory bail vide order dated 24.7.2018 passed in Cr.Misc.No. 27722 of 2017 and vide order dated 2.2.2018 passed in Cr.Misc.No. 63212 of 2017 by different Benches of this Court

Patna High Court Cr.Misc. No.25530 of 2018 (3) dt.23-07-2018 2/2 (Annexure-2) and investigation is pending against the petitioners. Heard learned APP also, who has opposed the prayer for anticipatory bail stating that the case is of the year 2011 and for the last seven years they have not appeared in this case. Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners. However, if the petitioners surrender and make prayer for regular bail, the same shall be considered by the learned court below in view of the fact that other co-accused persons have been granted anticipatory bail.

With the above observation, this application is disposed of.
