JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-10-2016 Heard the learned counsel for the petitioners and the learned A.P.P. representing the State.

The petitioners seek bail in connection with Chiraiya P.S. Case No. 118 of 2016 registered for the offences punishable under Section 47(a) of the Bihar Excise Act. Allegedly, the petitioners were coming on motorcycle with bag and after search from the bag, 90 bottles each containing 300 ml Nepali Saufi wine were recovered. The petitioners are in custody since 04.07.2016. In the facts and circumstances stated above, the petitioners, above named, are directed to be released on bail on

Patna High Court Cr.Misc. No.41784 of 2016 (2) dt.17-10-2016 2/2 execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sikarhana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 118 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
