The petitioner seeks bail in Kahalgaon P.S. Case No. 17 of 2017 registered under Sections 20 and 22 of the N.D.P.S. Act.
67 Kg ganja was recovered from a Scorpio vehicle and for that the accused persons including the petitioner was apprehended by the police from the said vehicle. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has been falsely implicated in this case. He has got no criminal antecedent. No incriminating article has been recovered from the conscious possession of the petitioner. He happens to be a driver and was
Patna High Court Cr.Misc. No.26604 of 2017 (2) dt.14-06-2017 2/2 hired by the owner of the vehicle to drop the female commuter of the vehicle to a particular destination. The petitioner is languishing in custody since 10.01.2017. Other co-accused have been enlarged on bail by this court vide order dated 16.05.2017 passed in Cr. Misc. Nos. 16805 of 2017 and 18169 of 2017.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, 1st Class, Bhagalpur in connection with Kahalgaon P.S. Case No. 17 of 2017.
