2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Complaint Case No. 818/2024 registered for the offences punishable under Sections 406, 420, 467, 468, 471, 323, 504 and 384 of the IPC.

3. The allegation against petitioner is to witness the sale deed agreement of petitioner with one Manisha Kumari for a piece of land, description of which is available in para no. 3 of the complaint petition.

4. It is submitted by learned counsel appearing on behalf of the petitioner that dispute is civil in nature, where maximum allegation against petitioner is to witness the sale deed agreement. It is submitted that petitioner is not the beneficiary of the agreement. Petitioner claimed clean antecedent.

Learned APP duly assisted by learned counsel for the informant while opposing the prayer of bail submitted that petitioner actively participated during the land deal and he also received certain amount in cash as broker, but he could not dispute the submission as advanced that petitioner signed the agreement of sale-deed in the capacity of witness only.

In view of aforesaid factual submission and by taking note of fact as petitioner prima-facie not appears beneficiary of the sale deed agreement, rather he signed agreement in the capacity of witness, where nature of dispute primarily appears civil in nature, accordingly petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Gaya/concerned Court, where the case is pending in connection with Complaint Case No. 818/2024, subject to the conditions as laid down under Section 482(2) of BNSS.
