JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Sikrahata P.S. Case No. 85 of 2016 for the offences punishable under Sections 147, 148, 149, 341, 385, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is in custody since 10.04.2017. It appears that the informant and the petitioner are co-villager. The informant is ex-Mukhiya of the Panchayat and the counsel for the petitioner submits that he has been made accused in this case because he is supporter of the present Mukhiya. In paragraph no. 3 of the petition, there is statement on affidavit that the petitioner has no criminal antecedent. From the order of the court below it appears that the parties have entered into compromise outside the court

Patna High Court Cr.Misc. No.27305 of 2017 (2) dt.01-07-2017 2/2 and the compromise petition has also been filed in the court below.

Having regard to the peculiar facts and circumstances of the case that parties are co-villager and they have entered into compromise outside the court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhojpur at Ara in connection with Sikrahata P.S. Case No. 85 of 2016, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
