2. The petitioner is in custody since 21.03.2017 in connection with Excise Case No. 282 of 2017 arising out of Wazirganj P.S. Case No. 110 of 2017 for the offences alleged under Section 30(a) of the Bihar Excise (Amendment) Act, 2016.
3. It is submitted that the petitioner has been falsely implicated in connection with the alleged recovery of 1080 litres of Royal Stag foreign liquor. It is submitted that the petitioner is merely the driver of the vehicle from which the recovery has been made and the petitioner has no knowledge of the contents which were admittedly kept in sealed jute bags. The goods were booked through Rama Roadways Private Limited and the name of the consignor and the consignee of the goods were duly mentioned.
4. Considering the nature of the accusations and gravity of the offence alleged, the quantity of recovery as well as that it appears that the documents produced by the petitioner mentioned the goods as liquor to be transported for Danapur canteen, this
Patna High Court Cr.Misc. No.27591 of 2017 (2) dt.06-07-2017 Court is not inclined to grant the privilege of bail to the petitioner. The bail petition stands dismissed.
