JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2017 The petitioner seeks regular bail in connection with Islampur P.S. Case No. 58 of 2017, registered for offences punishable under Sections 328, 302/34 of the Indian Penal Code. Allegation against the petitioners is of administering some substance to children of the informant causing their death. It has been submitted on behalf of the petitioners that petitioners have no hand in the alleged offence and the F.I.R itself shows that the allegation of administering poison to the children is against other co-accused person in conspiracy with the petitioners. Petitioners are old persons aged about 85 and 90 years and they are in custody since 29.03.2017.

Having heard both sides, in view of the fact that petitioners are old persons and it appears from impugned order that they are 85 and 90 years of age and no specific allegation has been attributed to them, as such, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, Hilsa, Nalanda, in connection with Islampur P.S. Case No. 58 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any
