The petitioners being the mother and brother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304-B/34 of the Indian Penal Code.

Accusation is of killing the daughter of the informant after four years of marriage for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that in fact the victim herself committed suicide but, subsequently, the case has been lodged. During investigation, it also transpired that the victim committed suicide.

It is submitted by learned counsel for the informant that the victim was killed after two years of marriage and the dead

Patna High Court Cr.Misc. No.32794 of 2015 (2) dt.11-08-2015 2/2 body was disposed of without informing the informant and there is infant child of the victim also.

Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Kajra P.S. Case No.43 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
