ANJANA MISHRA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Alamnagar P.S. Case No.62 of 2017 for allegedly having committed the offences under Sections 147, 148, 149, 341, 323, 324, 379 and 307 of the Indian Penal Code.
Learned counsel for the petitioners submits that the entire allegations are false and concocted and though some altercation had taken place between the parties for installing the grille at the gate of the petitioners, yet no occurrence has ever taken place. The injuries are also found to be simple in
Patna High Court Cr.Misc. No.27534 of 2017 (2) dt.13-07-2017 2/2 nature. Learned counsel for the petitioners further submits that these petitioners have no criminal antecedents save and except one case inter se between the parties.
Having heard learned counsel for the petitioners and the learned counsel for the State and considering the nature of allegations, let all the three petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Udakishunganj at Madhepura, in connection with Alamnagar P.S. Case No.62 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
