The petitioner seeks regular bail in connection with Barachatti (Mohanpur) P.S. Case No. 108 of 2018 for the offences punishable under Section 302/34 of the Indian Penal Code. The allegation in the present case is that the deceased had gone to in-law's place and there the accused persons are said to have killed him.
The learned counsel for the petitioner submits that the allegation itself is unbelievable inasmuch as there was no occasion for the wife to kill her own husband. It is further submitted that similarly situated accused persons including fatherin-law and mother-in-law of the deceased have already been granted bail by this Court vide order dated 17.07.2018 passed in
Patna High Court Cr.Misc. No.30731 of 2018 (4) dt.23-07-2018 2/2 Cr. Misc. No. 41333 of 2018. The petitioner is having a clean antecedent and is languishing in custody since 09.02.2018. Per contra, the learned counsel for the informant has vehemently opposed the prayer for bail and has submitted that the younger son of the informant has been killed by the accused persons.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sharghati at Gaya in connection with Barachatti (Mohanpur) P.S.
