JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 07-10-2015 Heard Mr. Sinha in support of the application seeking restoration of S.A. No. 63 of 2013 by extending the peremptory time granted under order dated 24.07.2014 whereby defects were directed to be removed within two weeks. In paragraph 3 of this application it has been stated that the two defects pointed out by the Stamp Reporter were removed. It appears that subsequently some defects were also pointed out for which a message was sent which was overlooked. Resultantly, the application stood dismissed. However, the defects pointed out subsequently were removed on 25.09.2014
Patna High Court MJC No.3831 of 2014 (4) dt.07-10-2015 2/2 Considering the facts and circumstances of the case and keeping in focus the interest of justice the application merits to be allowed. It is accordingly allowed. Peremptory time granted under order dated 24.07.2014 is extended to 25.09.2014 subject to deposit of a cost in the sum of Rs. 250/- with the Patna High Court, legal Services Committee and filing receipt thereof within 10 days.
