This is a petition for grant of regular bail for offence under Sections 153A, 120B, 295A and 34 of the Indian Penal Code and 67 and 67(A) of the Information and Technology Act, 2008.

Allegation against the petitioner is that he sent offscene photographs of Hindu Goddess on the mobile set of some other person with intent to create communal disharmony. The petitioner is in custody since 14.08.2016.

It has been submitted by the learned counsel for the petitioner that some other co-accused have already been allowed by this Court in Cr. Misc. No. 44739 of 2016 on 29.11.2016 by a coordinate Bench of this Court.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Maker P.S. Case No. 88 of 2016 to the satisfaction of Smt. Divya Shekhar, Judicial Magistrate, 1st Class, Saran at Chapra, or successor Court. (Birendra Kumar, J) SA/- U √ T √
