The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 342, 323, 324, 354 and 379 of the Indian Penal Code. It is alleged that the accused persons came and tried to drag the informant in the paddy field in order to ravish her. On alarm being raised the daughter of the informant came then petitioner no. 3 Rajesh Yadav assaulted the daughter of the informant with Khanti when the informant came to save petitioner no. 1 Lalan Yadav assaulted with sword to the informant when the husband of the informant came to rescue then petitioner no. 2 pointed pistol. It is also alleged that

Patna High Court Cr.Misc. No.34352 of 2015 (2) dt.14-08-2015 2/2 petitioner no. 1 Lalan Yadav snatched gold earring from the informant.

It is submitted by learned counsel for the petitioners that injury of the informant and daughter has been found superficial simple in nature. Petitioner no. 1 is the step father of the informant whereas petitioner nos. 2 and 3 are sons of petitioner no. 1 and in the background of land dispute the accusation has been leveled when Title Suit No. 46 of 2014 is pending and there is a counter version of the occurrence also. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 16 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
