JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 414 of the Indian Penal Code and 47 of the Bihar Excise (Amendment) Act.

Allegation against petitioner is that from the tempo in which he along with other accused was coming, 360 bottles of foreign wine of different quantity have been recovered It has been submitted on behalf of petitioner that he is in custody since 22.10.2016. No allegation of tampering of witnesses is alleged against petitioner. He has falsely been implicated in the present case. He has not been apprehended on the spot. Altogether 360 bottles of different quantity foreign liquor are said to have been recovered from the tempo in which they were travelling. There is no compliance of Section 100 of the Code of Criminal Procedure. Other co-accused has been granted bail vide Cr. Misc. no 46410 of 2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.51326 of 2016 (2) dt.05-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Muffassil P.S. Case no. 344 of 2016.
