The petitioner seeks bail in connection with Rahui (Bhagan Bigha) P.S Case No. 136 of 2015 registered for the offences punishable under Sections 341, 323, 326, 324, 307, 379/34 of the Indian Penal Code.
Allegedly, the petitioner and other F.I.R. named accused persons started assaulting the informant, the wife of Subodh assaulted on his mouth, Subodh Nut assaulted with knife on his neck, causing injury and further snatched Rs, 28,00/- Submission is of false implication and that the petitioner is an old man aged about 65 years, there is no specific
Patna High Court Cr.Misc. No.38260 of 2016 (2) dt.30-09-2016 2/2 allegation against him for committing any over act, he is suffering in custody since 20.07.2017 having no criminal antecedent and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. does not dispute.
In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of the Shri Sawaran Prabhat, Judicial Magistrate 1st Class, Nalanda, Biharsharif, in connection with Rahui (Bhagan Bigha) P.S. Case No. 136 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
