JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420 and 467 of the Indian Penal Code.

It is alleged that one Ajit Kumar Sharma appeared at the Constable Recruitment Examination in place of the petitioner. It is submitted by the learned counsel for the petitioner that the petitioner was not aware of the co accused Ajit Kumar Sharma appearing at the aforesaid examination in his place and even assuming the accusation, at best, a case under section 419 IPC is made out. It is further submitted that non grant of bail will jeopardize the future career of the petitioner. Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.34533 of 2015 (2) dt.01-09-2015 2/2 petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Madhubani, in connection with Rahika P.S. Case No.139 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate in the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in the investigation will give liberty to the prosecution to file application before the learned court below to cancel bail bonds of the petitioner. (Dinesh Kumar Singh, J) Anil/- U T
