The petitioner seeks bail in a case registered under Section 379/411 of the Indian Penal Code.

Allegedly, the motorcycle of the informant, parked at Patel Chowk in front of Sumit Electronic, was stolen away by some unknown miscreants.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-01-2019. Charge sheet has already been submitted. Stolen motorcycle is alleged to have been recovered from the petitioner. The name of the petitioner has come in the present case only on the basis of CCTV footage. It has further been submitted that the petitioner

Patna High Court CR. MISC. No.41417 of 2019(2) dt.05-07-2019 2/2 may be released after completion of nine months in custody. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of nine months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.
