The petitioner seeks regular bail in connection with Sherghatti P.S. Case No. 88 of 2017, registered under Section 30(A) of Bihar Prohibition and Excise Act, 2016. The allegation leveled against the petitioner and one other person namely Kapil Yadav is that when they were traveling in an Ambulance, the same was stopped by the police and upon search being conducted, 280 litres of liquor was recovered. Learned counsel for the petitioner submits that the petitioner is innocent, having no criminal antecedent and he is in custody since 15.02.2017 and the similarly situated co-accused

Patna High Court Cr.Misc. No.26945 of 2017 (2) dt.13-06-2017 2/2 person Kapil Yadav has been granted bail by a co-ordinate Bench of this Hon'ble court by an order dated 06.06.2017 passed in Cr. Misc. Case No. 25109 of 2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya in connection with Sherghatti P.S. Case No. 88 of 2017.
