1. Heard the parties.
2. Petitioners apprehend their arrest in connection with Mashrakh PS Case No. 284 / 2022 dated 15.06.2022 instituted for the offence under Section 420, 467, 468, 120-B of the Indian Penal Code.
3. As per the First Information Report, the petitioners in collusion with the Notary Public prepared a Will by forging the signature of the father of the informant pertaining to the
Patna High Court CR. MISC. No.46283 of 2023(2) dt.04-08-2023 2/3 property belonging to her father.
4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case by the daughter of the testator, who has executed the Will in the year 2006 in favour of the petitioners. The petitioners are nephew of the testator and cousin of the informant. A Probate Case was filed by the petitioners bearing Probate Case No. 07 / 2009 which was converted into Original Suit No. 16 / 2013 in which notice was also issued to the informant and informant had appeared in the original suit.

Regard being had to the submissions made by the parties, taking into consideration the material on record, the fact that petitioners being the legatee have already filed a Probate Case / Suit in which the informant is one of the parties and the informant is the cousin of the petitioners, accordingly, I am inclined to grant anticipatory bail to the petitioners.
6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest / surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chapra in connection with
