2. The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 363, 366A, 504, 508/34 of the Indian Penal Code and Sections 8 / 12 of the POCSO Act.

3. As per F.I.R., it is alleged that this petitioner, with the help of other co-accused persons, kidnapped the minor daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. During course of investigation, the victim was recovered and her statement under Section 161 Cr.P.C. was recorded, in which, she has

No.44028 of 2024(4) dt.10-01-2025 2/2 categorically stated that she was in love with this petitioner and as such, she went with him to Delhi and solemnized marriage there and both are living together as husband and wife. The Court below has also assessed the age of victim, as 20 years. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the statement of the victim recorded under Section 161 Cr.P.C., in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District Judge VI-cum-Special Judge, POCSO, Madhubani in connection with Basopatti P.S. Case No. 118 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
