ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner apprehends their arrest in connection with Kanhauli P.S. Case No. 40 of 2014 for the offences registered under Sections 341, 323, 324, 308/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is dispute for a piece of land between the parties. There is case and counter case between the parties with regard to the same occurrence. It appears from both the first information reports that both sides sustained injuries.

Considering the nature of allegation made against the petitioners and also the fact that they have got no criminal

No.34733 of 2014 (4) dt.05-08-2016 antecedents, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Kanhauli P.S. Case No. 40 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
