JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 385 and386/34 of the Indian Penal Code and section 17 of Criminal Law Amendment Act.
It is alleged that the extremists demanded extortion and subsequently called the informant at a particular place when the informant reached there, the accused persons escaped from the scene since the public got collected at the spot. Out of the escaped accused persons the informant identified one as Ajim Ansari. It is submitted by the learned counsel for the petitioner that the petitioner is not named in the FIR. His name sprang up in
Patna High Court Cr.Misc. No.34237 of 2015 (2) dt.18-08-2015 2/2 the confessional statement of co accused Tanjeem Ansari. It is further submitted that co accused Mansad Alam alias Chhotu and Taukir Alam have been granted anticipatory bail vide Cr. Misc. Nos. 5509 of 2014 and 5848 of 2014.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sikrahana, East Champaran in connection with Chiraiya P.S. Case No.114 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
