2. The present application, for grant of anticipatory bail, arises out of Dawath Police Station Case No. 414 of 2024, registered on 30.12.2024 for the offences under Sections 126(2), 115(2), 125(a), 109, 74, 76, 303(2), 351(2), 352, 3(5) of the BNS.

3. As per the First Information Report, on 27.12.2024 at about 7.00 PM while the informant was at his home, coaccused, Uperndra Chaudhary due to old enmity arrived there and started abusing him. When the informant protested, the said Upendra Chaudhary assaulted him with Lathi. Thereafter, the petitioner along with other accused persons arrived and started pelting stones and bricks due to which, the informant and his

4. Learned Senior counsel for the petitioner submits that both the parties are co-villagers, there is old enmity between the parties. The FIR has been lodged after delay of about three days inasmuch as the occurrence has taken place on 27.12.2024. Prior to the present FIR, brother of petitioner, Upendra Chaudhary had lodged an FIR on 27.12.2024 itself against the informant and his wife. The injuries sustained by the informant and his wife are simple in nature.

Having regard to the submissions made by the parties and taking into consideration the fact that there is case and counter case between the parties, they are on old inimical terms and the injuries sustained by the informant and his wife are simple in nature, I am inclined to grant the petitioner the privilege of anticipatory bail.

6. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with the aforesaid Police Station Case subject to the condition as laid down under Section
