The petitioner is apprehending arrest in a case registered for the offences punishable under Section 47a of the Excise Act.

From a Bolero vehicle foreign liquor in huge quantity were recovered when the driver of the vehicle escaped from the scene. Subsequently, during investigation, it transpired that the petitioner was the person, who escaped from the scene. It is submitted by learned counsel for the petitioner that petitioner left the driving of the alleged Bolero vehicle much prior to the alleged date of seizure. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sirdala P.S. Case No.84 of 2015, pending before the learned Chief Judicial Magistrate, Nawada.

With the above observation, this application is, accordingly, disposed off.
