JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-08-2015 Heard learned counsels for the petitioners and the State. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 395 and 397 of the I.P.C.

The accusation against the petitioners is of dacotiy and assault.

It is submitted by the learned counsel for the petitioners that the co-accused has been acquitted and the petitioners have been made accused on confessional statement of co-accused which has no evidentiary value.

The aforesaid facts constitute a good ground for

Patna High Court Cr.Misc. No.35673 of 2015 (2) dt.21-08-2015 2/2 consideration of regular bail, if the petitioners surrender within a period of six weeks in connection with Bochaha P.S. Case No. 151 of 2002 pending in the Court of Chief Judicial Magistrate, Muzaffarpur.

With the observations above, the application stands disposed off.
