The petitioner is apprehending his arrest in a case registered for the offences punishable under sections 394/34 of the Indian Penal Code.
Accusation is making assault and snatching of motorcycle, cash amount and mobile phone.
It is submitted by the learned counsel for the petitioner that petitioner is not named in the first information report but his name figured in the confessional statement of coaccused. It is submitted by the learned counsel for the petitioner that petitioner is the resident of the panchayat of the informant and is known to the informant from before. The informant filed a
Patna High Court Cr.Misc. No.33694 of 2015 (2) dt.13-08-2015 2/2 petitioner before the learned Sessions Judge that the informant is known to the petitioner and he was not involved in the occurrence. Petitioner has no criminal antecedent and a statement to this effect has been made in paragraph three of the petition. Considering the aforesaid facts, the above named petitioner in the event of his arrest or surrender before the court below within a period of 12 weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M, Saharsa in Salkhua P.S. Case No. 36 of 2015, subject to the conditions laid down under section 438(2) Cr.P.C.
