JUSTICE SANJAY PRIYA ORAL ORDER 3/ 26-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Forbesganj P.S. Case No.09 of 2017 instituted for the offence under Section(s) 364, 392 Indian Penal Code.

Petitioner is not named in the First Information Report. As per allegation in the written report, on the date of occurrence, four persons came riding on a Maruti Car and asked about the paper of the tractor of the informant. Two persons lifted them in the Maruti Car and proceeded towards Narpatganj. Driver of the tractor jumped out of the car. The accused persons asked about the name and after assaulting snatched Rs.350/- and Samsung Mobile with SIM No.8651988083 and also Lava Mobile of the informant's friend.

No.26842 of 2017 (3) dt.26-07-2017 2/2 It is alleged that during investigation Samsung Mobile has been recovered from the possession of this petitioner which is said to be one of the looted articles. It has been submitted that one of the co-accused from whose possession amount of Rs.350/- is said to have been recovered, has been granted bail by the Court below itself. Another co-accused, Md. Guddu @ Guddu, has been granted bail by a co-ordinate Bench of this Court by order dated 13.07.2017 passed in Cr. Misc. No.26447 of 2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No.09 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
