JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 414 of the Indian Penal Code and Section 25(1-b)A/26/35 of the Arms Act.

Two motorcycles were apprehended on suspicion to be stolen property, one was being driven by the petitioner. Submission is that nothing else was recovered from the possession of the petitioner. The said motorcycle was in the name of the father of the petitioner; hence, the same has already been released in favour of the father of the petitioner. Arms were recovered from another motorcycle rider. Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.50492 of 2016 (2) dt.22-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur, Supaul/Successor Court, in connection with Nirmali P.S. Case No.76 of 2016.
