JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-08-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,149,431,427,337,353,323 and 307 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.
It is alleged that when the informant being police officer went to get the blockade removed then accused persons abused the informant by calling the caste name and damaged the public

It is submitted by the learned counsel for the petitioners that the mob was protesting against a road accident due to inaction of the police, hence in order to save his own skin the informant being police officer registered the case against the mob. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya in connection with Khijarsarai P.S. Case No.146 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
