Petitioners are named in the first information report but general allegation of assault has been leveled against them and it were co-accused Tussan Chaudhary and Manoj Chaudhary, who gave rod blow on the head of the deceased.

No doubt, three other persons also sustained injuries in the occurrence but impugned order goes to show that the injured of this case sustained simple injuries and so far as deceased is concerned, he died of his head injury, which is attributed to coaccused Tussan Chaudhary and Manoj Chaudhary. Patna High Court Cr.Misc. No.40705 of 2016 (2) dt.04-10-2016 2/2 or less similar allegation, co-accused Sanjeev Choudhary and Sunil Choudhary have already been granted privilege of bail. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Roh P.S.Case No. 20 of 2016.
