Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Gopalganj Town P.S. Case No.62 of 2023 dated 28.01.2023 registered for the offence(s) punishable under Section(s) 147, 148, 149, 323, 324, 307, 302, 109 and 120(B) of the Indian Penal Code.

The main submissions advanced by learned counsel for the petitioner are that the instant matter relates to a communal riot in between the persons of two communities, though the petitioner is named in the FIR but against him there is no specific allegation and the allegation of having assaulted the informant's son by means of lathi, danda and iron rod is against the co-accused persons detailed in the FIR and several

No.44275 of 2023(2) dt.25-07-2023 2/2 persons have been named in the FIR and 30 to 35 persons have been shown as unknown in the FIR, the petitioner has fair and clean antecedent and has been languishing in jail since 01.02.2023 and he himself surrendered before the Court below and against him the investigation has been completed. 4.

Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the completion of investigation against the petitioner, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail in connection with Gopalganj Town P.S. Case No.62 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
