In the background of persisting love affairs in between deceased with Ria @ Rehana, while the deceased had gone on the fateful day to the place of Ria @ Rehana, that was his last visit. His dead body was found having injuries caused by sharp cutting weapon which happens to be the cause of death as per postmortem report. A letter was found in the pocket of deceased during course of inquest and that has been incorporated under para-24 whereunder there happens to be discloser against the petitioner no.2, Samsad Alam with regard to threatening since before over the alleged affair.
Accordingly, prayer for bail of petitioner no.2,
Patna High Court Cr.Misc. No.47988 of 2018 (3) dt.13-09-2018 Samsad Alam is, hereby, rejected.
So far petitioner no.1, Manjoor Alam is concerned, he is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town PS Case No. 789/2017.
