JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Madhepura P.S. Case No. 232 of 2017 for the offence under Sections 379 and 411 of the Indian Penal Code. In Para-3 the petitioner has stated on affidavit that he has fair antecedent. The FIR was lodged against him. Later on the police commando apprehended the petitioner and one Md. Manzar along with stolen motorcycle.

From the seizure list, it appears that motorcycle was not recovered from the possession of the petitioner. The seizure list indicates that the said motorcycle was seized in front of Madhepura College near a Peeple tree.

Having regard to the facts that petitioner has no

Case No. 232 of 2017 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
