2. The petitioner is apprehending his arrest in connection with Siwan Town P.S Case No. 521 of 2024, for the offences under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution story, total 30.8 litres of illicit country made liquor kept in a sack was recovered from a motorcycle bearing Registration No. BR29U-4377.

4. Learned counsel for the petitioner submit that petitioner has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of this petitioner. Petitioner is not named in the F.I.R.. The petitioner is the registered owner of the seized motorcycle bearing Registration No. BR29U-4377. The

Patna High Court CR. MISC. No.41572 of 2025(2) dt.16-07-2025 2/2 petitioner had purchased the said motorcycle on 09.11.2025 and remained its owner till 18.06.2023. The petitioner had executed a sale letter on 18.06.2023 in favour of one Chandan Kumar Chauhan on affidavit and put his signature on Form 29 for the purpose of transfer of name of ownership of the vehicle. Petitioner has no concern with the alleged recovery. Petitioner has no criminal antecedent.

5. Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail.

Keeping in view the aforesaid facts and also considering clean antecedent of the petitioner, let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Siwan in connection with Siwan Town P.S Case No. 521 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S. (S. B. Pd. Singh, J) Ranjeet/- U T
