JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Nathnagar (Madhusudanpur) P.S. Case No. 236 of 2015 for the offence under sections 414, 413/34 of the Indian Penal Code. The name of the petitioner has been disclosed by four persons apprehended on the spot along with 500 meters of high tension electric wire and one magic van.
The petitioner surrendered on 23.1.2017 in the present case and he was remanded on 28.3.2017 in Nathnagar (Madhusudanpur) P.S. and since then he is in jail custody. It appears from the order dated 9.2.206 in Cr. Misc. No. 6255 of 2016 that Pudda Mandal @ Sandeep Kumar was granted anticipatory bail, Gaurav Kumar was granted bail vide
Patna High Court Cr.Misc. No.27181 of 2017 (2) dt.01-07-2017 2/2 order dated 25.5.2016 in Cr. Misc. No. 22584 of 2016, Mukesh Mandal was granted bail in Cr. Misc. No. 26865 of 2016 vide order dated 13.07.2016 and Chhabi Kant Mandal was also granted anticipatory bail in Cr. Misc. No. 52644 of 2016 by different benches of this court. The case of this petitioner is identical to the co-accused who have been granted either anticipatory bail or regular bail as discussed above and the petitioner is in custody since 28.3.2017 in this case and on the ground of parity, I am inclined to enlarge the petitioner named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Bhagalpur or the successor court, in connection with Nathnagar (Madhusudanpur) P.S. Case No. 236 of 2015, G.R. No. 3942 of 2016 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, influence the evidence or the witnesses.
