JUSTICE RAKESH KUMAR ORAL ORDER 07-07-2015 Sri Arun Prasad Ambashtha, learned counsel for the petitioner, in presence of learned AC to SC No.25 as well as Sri Kumar Uday Singh, learned counsel for the private respondents submits that the present writ petition is in relation to a dispute under Section 48D of the Bihar Tenancy Act, 1885 which is a scheduled Act under the provisions of Bihar Land Tribunal Act, 2009.
Since the Bihar Land Tribunal constituted under the Bihar Land Tribunal Act, 2009 is already functioning, the court considers that this matter can well be adjudicated by the Bihar Land Tribunal.
Accordingly, in terms of proviso to Section 15 of the
Patna High Court CWJC No.18685 of 2011 (3) dt.07-07-2015 2/2 Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record of this case to the Bihar Land Tribunal forthwith.
