ANJANA MISHRA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Balrampur (Telta) P.S. Case No.94 of 2014 for allegedly having committed the offence under Sections 366A and 372/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the victim used to visit his shop in connection with repair work of Payal as he is the owner of a jewellery shop. Learned counsel further submits that the allegation as made out by the informant is that his elder daughter had earlier seen that the victim girl was making casual and friendly talk with the petitioner and co-accused Varun

Patna High Court Cr.Misc. No.32313 of 2015 (2) dt.17-08-2015 2/2 Kumar Chaudhary in the said shop.

Considering the nature of allegations made and the remoteness and vagueness of the allegation and also that the co-accused Varun Kumar Chaudhary has been extended the privilege of anticipatory bail by a Bench of this Court vide order dated 1.7.2015 passed in Cr.Misc. No.49732 of 2014, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in connection with Balrampur (Telta) P.S. Case No.94 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
