JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-09-2018 The petitioner seeks regular bail in connection with Gogari P.S. Case No. 51 of 2018, registered for offences punishable under Sections 25(i)a, 26 (i), 29 and 35 of the Arms Act.
Allegation against the petitioner is of recovery of 10 semi manufactured country made pistols along with other articles. It has been submitted on behalf of the petitioner that in fact nothing has been recovered from the possession of the petitioner and he has falsely been made accused in this case and he has no criminal antecedent and has been in judicial custody since 22.02.2018.
Heard learned A.P.P. also.
Considering the aforementioned facts and circumstances
Patna High Court Cr.Misc. No.47572 of 2018 (3) dt.20-09-2018 2/2 and also the fact that huge quantity of semi manufactured country made pistols have been recovered from the petitioner, I am not inclined to enlarge him on bail.
This application is accordingly dismissed.
However, since the petitioner has been in judicial custody, the trial court is directed to expedite and conclude the trial as early as possible.
