The petitioner is seeking regular bail in Khaira P.S. Case No. 84 of 2017 under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act, 2016.
Learned counsel for the petitioner submits that the vehicle belongs to one Gopal Barnwal and the present petitioner has no knowledge of the alleged foreign liquor. He would further submit that the seizure is not in accordance with Section 100 of the Code of Criminal Procedure, the petitioner has no criminal antecedent and he is in jail since 02.04.2017. Considering the facts and circumstances of the case

No.27490 of 2017 (2) dt.01-07-2017 2/2 as also that the petitioner has no criminal antecedent and he is in jail for three months by now, let the petitioner, namely, Chandan Kumar be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in Khaira P.S. Case No. 84 of 2017, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
