The petitioner is apprehending her arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
Ten bags of rice were being transported on Auto Rickshaw. It is alleged against the petitioner that the rice was carried for distributing to the villagers and on the way Auto Rickshaw was intercepted and there is no accusation that the rice was being sold to anyone.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, let the
Patna High Court Cr.Misc. No.34406 of 2015 (2) dt.14-08-2015 2/2 above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Banka in connection with Belhar (Kheshar) P.S. Case No. 160 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
